Before you sign a contract please read this important information
Buying a home will probably be the most important and expensive transaction you will ever enter into. For this reason it is most important that you approach the transaction with as much information as possible.
If you require finance to assist you to complete the purchase you should obtain written loan approval from your lending body before exchange of contracts or before the 5 day cooling off period. The real estate agent may offer you a cooling off period. Please contact us before you agree to that. There are hidden dangers.
Things you should look for in the contract
Property Subject to Lease
If you are purchasing a property subject to an existing lease, you should read the lease agreement carefully prior to exchange. Please do not hesitate to contact us if you have any difficulties in this regard.
Location of Sewer Main
Before
exchange you should ascertain the location of any sewer or drainage mains to ensure they do not interfere with your intended use of the land. If you intent to erect a structure over or in the vicinity of such sewer or drainage mains you will require approval of Council and/or the Water Board and will incur expense in complying with their requirements.

Quality of Property
You should obtain expert advice about the quality of the property before entering into the contract or during any cooling off period. There is no guarantee given by the vendor of the structural soundness of the improvements on the land. Most purchasers retain the services of qualified consultants to provide written reports on the condition of the property, such as timber pest inspection and building inspection. We can assist you.
After exchange of contracts
During this period:
- Searches and enquiries are made to ensure that there are no defects in the title to the land.
- Your lending body (if any) will prepare the mortgage documents and arrange for you to sign them.
- On the completion date you should carry out final inspection before the arranged completion time to ensure that;
- the vendor or tenant has vacated;
- the property is not damaged;
- all furnishings and chattels listed in the contract are intact;
- the agent has all keys to the premises. The agent will hand the keys to you on completion. If there is no agent, you should make arrangements directly with the vendor regarding final inspection and collection of keys.
You should contact our office before the agreed completion time if there are any problems arising out of the final inspection.
